Attorneys Carl J. Mayer and Bruce I. Afran filed a complaint Friday in the Southern U.S. District Court in New York City on my behalf as a plaintiff against Barack Obama and Secretary of Defense Leon Panetta to challenge the legality of the Authorization for Use of Military Force as embedded in the latest version of the National Defense Authorization Act, signed by the president Dec. 31.

The act authorizes the military in Title X, Subtitle D, entitled “Counter-Terrorism,” for the first time in more than 200 years, to carry out domestic policing. With this bill, which will take effect March 3, the military can indefinitely detain without trial any U.S. citizen deemed to be a terrorist or an accessory to terrorism. And suspects can be shipped by the military to our offshore penal colony in Guantanamo Bay and kept there until “the end of hostilities.” It is a catastrophic blow to civil liberties. The Obama administration overruled recommendations from within the US Department of Homeland Security and implemented new guidelines earlier this year that allow the government to gather and analyze intelligence on every single US citizen.

Since the spring, a little-know intelligence agency outside of Washington, DC has been able to circumvent the Fourth Amendment to the US Constitution and conduct dragnet surveillance of the entire country, combing massive datasets using advanced algorithms to search and seize personal info on anyone this wish, reports the Wall Street Journal this week.

There’s no safeguard that says only Americans with criminal records are the ones included, and it’s not just suspected terrorists that are considered in the searches either. The National Counterterrorism Center (NCTC) has been provided with entire government databases and given nearly endless access to intelligence on everyone in the country, regardless of whether or not they’ve done anything that would have made them a person of interest. As part of the Beyond the Border initiative, the U.S. and Canada are strengthening cybersecurity cooperation. In a move that received little attention, both countries recently announced a joint cybersecurity action plan. Cyber threats know no national borders which has made the issue an important security concern. A fully integrated North American security perimeter would be entrusted with preventing and responding to any such attacks.

One of the key priorities identified in the November 2011 Beyond the Border Action Plan is cybersecurity. The agreement lays the framework for enhancing U.S.-Canada, “bilateral cyber-security cooperation to better protect vital government and critical digital infrastructure and increase both countries’ ability to respond jointly and effectively to cyber incidents. This will be achieved through joint projects and operational efforts, including joint briefings with the private sector and other stakeholders, and the enhancement of real-time information sharing between operation centres.” The deal will also works towards strengthening, “cooperation on international cyber-security and Internet governance issues to promote prosperity, enhance security and preserve openness in our networked world.” Merging cyber threat strategies would force Canada to further bring its security practices in line with American ones and under the reach of the Department of Homeland Security (DHS).

On October 26, Public Safety Canada and the DHS released a Cybersecurity Action Plan which represents a key commitment under the Beyond the Border agreement. A press release explained that the specific goals include, “enhancing collaboration on cyber incident management between each country’s cyber security operations centres, improving information sharing and engagement with the private sector, and continuing the ongoing collaboration between Canada and the U.S. on the promotion of cyber security awareness to the public.” The new joint action plan promotes a shared approach to cybersecurity and digital critical infrastructure protection. Building on these initiatives, both countries also seek to further integrate cyber capabilities into military command structures.Read More.......

In a new lawsuit, Angel Dobbs and her niece Ashley Dobbs, of Irving Texas, say they were searched inside their underwear by female Texas Trooper, Kelley Helleson, after a routine traffic stop in Dallas in July.

The trooper who pulled them over, David Farrell, says on tape he saw them throw a cigarette butt out the window and smelled marijuana when he pulled them over. No drugs were found and they were released with a warning. The cousins say the trooper who performed the search used the same pair of gloves on both women. The cousins are now suing the Department of Public Safety.

Surveillance video released Wednesday afternoon shows two former Chattanooga police officers savagely beating a homeless man last summer at the Salvation Army.

Police said at the time Tatum kept fighting even after they took away the knife. They said they used Mace and a stun gun on Tatum, but neither seemed to affect him. They continued to strike Tatum until he stopped fighting, they said in earlier newspaper stories.

The video showss Tatum on the floor much of the time, pleading with officers to stop striking him.

Tatum suffered six fractures to his right leg and two fractures to his left leg, including a compound fracture.

"The only thing I can tell you is that the video speaks for itself," said Chattanooga attorney Robin Flores.

Flores has filed a $50 million lawsuit in Hamilton County Circuit Court

The lawsuit names two former Chattanooga police officers, three current police officers, 11 unidentified police officers, the city and Erlanger Health Systems.

As a result of the incident, Officers Adam Cooley and Sean Emmer were fired. James Smith, one of the first responding officers, was not disciplined.

Chattanooga Police Chief Bobby Dodd said Wednesday night he fired the officers and pushed for criminal prosecution.

"I met with the district attorney to seek prosecution. The determination was made to present it to the grand jury. I also contacted the FBI to look into it for possible civil rights investigation," Dodd said.

The grand jury declined to indict the officers. As of Wednesday night, no federal charges were filed against the officers.

DALLAS (CBS 11 NEWS) - CBS-11 has learned two state troopers involved in a controversial roadside cavity search of two North Texas women have been indicted on criminal charges by a Dallas County Grand Jury.

CBS-11 has learned that one of the troopers, Kelley Helleson, who left the courthouse after testifying Friday, is charged with two counts of sexual assault and two counts of official oppression.

She was seen on dashcam video searching the body cavities — front and back — of the two women along an exit ramp of the Bush Turnpike in Irving last summer.
